DMCA

Hello everyone, welcome back to Tôi Share! If you clicked on this static page, you are probably looking for our official DMCA (Digital Millennium Copyright Act) & Intellectual Property Policy, or maybe you just accidentally scrolled down to the footer of my blog and got curious about how a high school blogger protects his brainpower on the internet.

Introduction: Late-Year Northeast Monsoon and the Story of Protecting Brainpower

Right now, as I sit at my desk typing these lines for the DMCA policy page, we are right in the middle of the last two months of the year—November and December. Brothers and sisters living in Hanoi and Northern Vietnam, do you feel how brutal the weather has become lately? After weeks of weird, suffocating autumn heat where I still had to turn on the air conditioner at night, the real Northeast monsoon (gió mùa đông bắc) has finally slammed into the North. It is freezing. Not the gentle chill anymore, but that dry, bone-cutting winter wind that makes your hands burn the moment you step outside the front door.

Every morning when my alarm goes off, stepping out from under my thick cotton blanket onto the cold floor feels like pure torture. My school, Phan Dinh Phung High School, is only about one kilometer away from my house near Quan Thanh and Nguyen Truong To streets, yet riding to school in this early morning winter wind makes me shiver uncontrollably. And honestly, everytime the temperature drops deep at night during these final two months of the year, I worry so much about my family—especially my grandfather whose health gets weaker whenever the weather turns freezing, and my dad who has to wake up at 3:00 AM in the pitch-black, freezing cold morning to go work as a hotel chef, then comes back at 12:00 PM noon to drive Grab all afternoon. Seeing my parents work that hard out in the cold wind makes me realize that every single piece of honest work deserves respect.

Writing a blog is the exact same thing. I was born in 2009, and right now I am burying my head in books to prepare for the 2027 National High School Graduation Exam (THPTQG), so free time is a luxury for me. Whenever I sit down at my computer with freezing fingers, sipping a cup of hot water to write an analytical article, share a Blogger template, or code a web tool for you guys, I am pouring my own real human brainpower—my "gray matter"—into every single paragraph. While anyone can now use AI tools to scramble and rewrite a competitor's blog post in less than 30 seconds to claim it as their own, Tôi Share refuses to do that. I write with my own hands, my own memories, and my own code. Because of that, I take copyright protection and the Digital Millennium Copyright Act (DMCA) extremely seriously.

1. What is DMCA and What Legal Frameworks Do We Follow?

Some of you in the Vietnamese Blogspot community might ask: "Hey Anh Vu, we live in Vietnam and write blogs for Vietnamese readers, why do we use an English term like DMCA?" The answer is very simple! Even though my blog Tôi Share (toishare.net) is operated from Hanoi, Vietnam, the entire infrastructure hosting this website runs on Google's Blogger (Blogspot) servers and Cloudflare's global edge network, both of which are headquartered in the United States and governed directly by US federal copyright law alongside international treaties.

To ensure complete transparency, trustworthiness, and legal compliance, the copyright protection framework of Tôi Share is built upon four official, authoritative legal pillars:

  • The Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512): Enacted by the United States Congress and administered by the U.S. Copyright Office, specifically Section 512(c) regarding Online Copyright Infringement Liability Limitation ("Safe Harbor" provisions) and formal Notice-and-Takedown procedures.
  • The Berne Convention for the Protection of Literary and Artistic Works: Administered by the World Intellectual Property Organization (WIPO), which establishes that original literary and artistic works—including blog articles, personal photography, and source code—are automatically protected the moment they are created and fixed in a tangible medium, without requiring formal registration across 181+ contracting countries (including both Vietnam and the United States).
  • Law on Intellectual Property of Vietnam (Luật Sở hữu trí tuệ Việt Nam): Consolidated under Law No. 50/2005/QH11 and amended by Law No. 07/2022/QH15, which protects journalistic works, computer programs, data compilations, and digital content against unauthorized reproduction or distribution in cyberspace.
  • Google Transparency & Blogger Legal Removal Policies: Enforced directly via the Google Copyright Transparency Report system and Google's Legal Troubleshooter, which processes millions of URL delisting and Blogger content removal requests globally every year.

2. Real-World Copyright Experience at Tôi Share (Why We Walk the Talk)

I do not write this policy page just to look professional or copy a generic legal template from another website. If you have followed my blogging journey since late 2021—back when I was just a 7th grader stuck at home learning online during the COVID-19 lockdown, tinkering with basic HTML, CSS, and JavaScript on my very first terrible blog called "lOGHITECHUR", then moving on to "Cevta", "ANewPlus", "ANewStudy", and finally establishing Tôi Share in August 2025—you know how much it hurts to have your hard work stolen.

Let me share two real experiences from my own life running this blog so you understand our stance on copyright:

2.1. Respecting Other People's Trademarks and Copyrights

Back in July and August 2026, I briefly merged my database and rebranded my blog under the name "Sata Blog" (which stood for Sáng Tạo - Creativity). Right after the transition, I discovered a serious problem: an image and slogan I used overlapped with an existing startup forum and an educational blog project (Sata Edu) that had temporarily paused operations. Did I ignore it and keep using their visual assets? No way. On August 30, 2026, after communicating directly and reaching a respectful agreement with the original brand owners, I immediately overhauled my entire visual identity, threw away the old green logo, designed a brand-new red-and-white "S" logo, and officially restored our independent name: Tôi Share | Website Chia Sẻ Thủ Thuật - Kiến Thức Công Nghệ Khoa Học. We respect the law and other creators' intellectual property unconditionally.

Even when we share modified Blogger themes—like the T-Plus UI Liquid Glass (iOS 26 style) modded from HieuDevs' Plus UI, or Lantro UI V2.0 originally designed by the Coshix team, or the Blogspot Info Lookup Tool coded by NVMH—we always interview or credit the original developers, state clearly whether a resource is a free community mod or commercial, and remind our readers to purchase official licenses from the original designers whenever copyright rules tighten. We saw how even legendary parody creators like Vanh Leg had to stop making parody music after 2018–2020 because of strict YouTube copyright strikes. Copyright is no joke.

2.2. Our Self-Built Anti-Scraping & DMCA Tracking Technology

Because so many bad actors exploit Blogspot's open RSS feeds, embed unauthorized <iframe> tags, or use automated scripts to mirror entire websites, I spent my summer break in May 2026 writing over 1,000 lines of custom code running 100% serverless on Cloudflare Workers, D1 SQL Database, and Worker KV to build the Tôi Share Blogspot Admin & Security System.

Technical Warning to Content Thieves: Our Cloudflare Worker HTMLRewriter layer and raw access logs actively monitor every suspicious request in real time. Our system logs IP addresses, ASN/ISP networks, Device Fingerprints, browser headers, and hardware states. Furthermore, using our custom Sitemap XML URL Extractor Tool, we can parse an infringing website's entire sitemap.xml in seconds to extract every stolen URL and submit bulk DMCA takedown notices to Google Search Console, Cloudflare Abuse, and your hosting provider without having to click links manually.

3. Ownership of Content on Tôi Share (toishare.net)

Unless explicitly credited to a third-party developer or external source, all original materials published on https://www.toishare.net/ are the exclusive intellectual property of Tôi Share (Founder & Administrator: Anh Vũ / Phạm Thanh Thanh Chúc). This protected content includes, but is not limited to:

  • Original Written Articles & Essays: All weather analyses (El Niño, La Niña, Northeast monsoon reviews, hail, thunderstorms, typhoons), social media commentary, personal Hanoi diaries, and technology reviews written by our team.
  • Custom Source Code & Scripts: All HTML, CSS, JavaScript snippets, JSONP recent comment widgets, Blogger API v3 lookup tools, Sitemap URL extractors, and Cloudflare Worker scripts carrying the trickpro, sata, or toishare namespaces.
  • Visual Graphics & Photography: Original street photography taken around Hanoi (Phan Dinh Phung High School, Quan Thanh Street, Nguyen Truong To Street, Pham Hong Thai Street, West Lake, Hoan Kiem Lake), custom Canva thumbnails (1280x720), and brand logos.

What You Are Allowed to Do (Fair Use & Sharing Rules):

  1. You may quote short excerpts (under 150 words) of our analytical articles for educational commentary, news reporting, or non-commercial discussion, provided that you include a visible, do-follow hyperlink pointing directly back to the original post URL on toishare.net.
  2. You may use the free HTML/CSS/JS widgets and tools shared in our "Share Code" category on your personal blog, provided that you keep the copyright credit comment intact inside the source code and do not repackage our free code to sell for money.

What Is Strictly Prohibited:

  1. Copying 100% of our HTML post body via Blogger Atom/RSS feeds (/feeds/posts/default) or scraping our articles to republish on another website without permission.
  2. Using AI paraphrasing tools to spin, translate, or slightly reword our personal stories and technical tutorials to pass them off as your own original work.
  3. Hotlinking our hosted images or cloning our site interface via proxy/mirroring techniques.

4. How to Submit a DMCA Takedown Notice to Tôi Share

We are human beings—mostly students and young writers working late at night in this freezing Hanoi winter—so despite our best efforts to verify every image and credit every developer, mistakes can occasionally happen. If you are a copyright owner (or an authorized legal agent) and you believe that any content, image, template, or piece of code hosted on toishare.net infringes upon your copyright, please do not hesitate to contact me directly. I promise I won't make excuses or hide; we will verify and remove or credit the material immediately.

In accordance with 17 U.S.C. § 512(c)(3) of the Digital Millennium Copyright Act, your written DMCA Takedown Notice must include the following six mandatory elements:

  1. Identification of the Copyrighted Work: A clear description of the original copyrighted work that you claim has been infringed, including the official URL or registration details where the original work can be verified.
  2. Identification of the Infringing Material: The exact, full URL(s) on https://www.toishare.net/ where the allegedly infringing content is located (please do not just send the homepage URL; give me the exact post link so I can find it right away).
  3. Your Contact Information: Your full legal name, organization/company name (if applicable), physical mailing address, telephone number, and a valid email address (preferably an official domain email) so I can reply to you once the issue is resolved.
  4. Good Faith Belief Statement: A statement reading: "I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy and Perjury Statement: A statement reading: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or person authorized to act on their behalf.

5. Counter-Notification Procedure (Pursuant to 17 U.S.C. § 512(g))

If content you contributed or commented on Tôi Share was removed due to a DMCA notice and you believe the removal was the result of a mistake or misidentification (or constitutes fair use), you may submit a written Counter-Notification containing:

  • Identification of the specific URL and material that was removed, and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Google LLC may be found), and that you will accept service of process from the person who provided the original DMCA notification.
  • Your physical or electronic signature.

6. Response Time & Designated Contact Channels

Because I attend classes at school during the day and study for my upcoming graduation exams in the evening, I might not see your message the exact second you send it. However, because our custom admin system forwards alerts directly to my phone via Telegram API and Resend Email API, all valid DMCA notices are reviewed and acted upon within 24 to 48 hours (usually the same evening after I finish my homework).

Don't forget to click the blue notification bell at the bottom right corner of the screen to receive the latest updates from Tôi Share! Stay warm in these freezing late-year monsoon days, remember to wear a thick jacket when going out early in the morning, and thank you for respecting human creativity.

Conclusion

Thank you for reading this policy page, and thank you for accompanying Tôi Share. We wish you good health, warmth, and happiness with your loved ones and family during these cold winter days at the end of the year! Goodbye. (update 23:25 PM - 02/11/2026)
